Agreement to Terms
Welcome to HōMI. By accessing or using our platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms apply to all users of the platform, including clients, financial coaches, and visitors.
Description of Service
HōMI provides Decision Readiness Intelligence services to help individuals make informed decisions about major life choices, particularly in the area of homeownership. Our services include:
- Decision readiness assessments using our proprietary HōMI Score
- Matching with fee-only financial coaches
- Personalized guidance and coaching sessions
- Progress tracking and goal management tools
- Educational resources and decision support
Important: HōMI is not a financial advisor, lender, real estate agency, or insurance provider. We do not sell financial products or earn commissions from third parties. Our coaches are fee-only professionals paid directly by you.
User Accounts
Account Creation
To use HōMI, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your information remains accurate and up to date
Eligibility
You must be at least 18 years old to use HōMI. By creating an account, you represent that you meet this requirement and have the legal capacity to enter into this agreement.
Account Termination
You may close your account at any time. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activity.
Acceptable Use
You agree not to:
- Use HōMI for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Provide false, misleading, or inaccurate information
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the platform's operation
- Harass, abuse, or harm other users or coaches
- Use automated systems (bots, scrapers) without permission
- Reproduce, modify, or distribute our content without authorization
- Reverse engineer or attempt to extract our proprietary algorithms
Coach Relationships
Independent Professionals: Financial coaches on HōMI are independent professionals, not employees of HōMI. The coaching relationship is between you and the coach directly.
Coach Selection: While we match you with coaches based on your needs and preferences, you are responsible for evaluating whether a coach is right for you.
Coach Conduct: Coaches must adhere to professional standards and our Coach Code of Conduct. If you have concerns about a coach's conduct, please contact us immediately at support@hömi.com
Payments and Fees
Platform Fees
HōMI charges a platform fee for access to our services, including assessments, coach matching, and platform features. Fees are clearly disclosed before you make any payment.
Coach Fees
You pay coaches directly for their services. Coach fees are set by the individual coach and agreed upon between you and the coach. HōMI facilitates payment processing but does not determine coach pricing.
Refund Policy
Platform fees are non-refundable except as required by law or at HōMI's sole discretion. Refunds for coach services are subject to each coach's individual refund policy.
Payment Processing
We use third-party payment processors to handle transactions securely. You agree to comply with their terms of service and authorize us to charge your payment method for all fees.
Disclaimers and Limitations
No Financial Advice
HōMI provides decision support tools and access to financial coaches, but we do not provide financial advice ourselves. The HōMI Score is an assessment tool, not a recommendation or guarantee. All decisions are ultimately yours to make.
No Guarantees
We do not guarantee any specific outcomes from using our platform. Success depends on many factors, including your individual circumstances, effort, and external conditions beyond our control.
Service "As Is"
HōMI is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, HōMI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the service
- Any bugs, viruses, or other harmful code
- Any errors or omissions in any content
- Any loss or damage incurred as a result of your interactions with coaches
Intellectual Property
All content on HōMI, including but not limited to text, graphics, logos, images, software, and the HōMI Score algorithm, is the property of HōMI or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use HōMI for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of our services or content without written permission.
User Content
You retain ownership of any content you submit to HōMI (messages, assessment responses, feedback, etc.). By submitting content, you grant HōMI a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display that content for the purpose of operating and improving our services.
You represent that you have the right to submit any content you provide and that it does not violate any third-party rights or laws.
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using HōMI, you consent to our privacy practices.
Indemnification
You agree to indemnify, defend, and hold harmless HōMI and its officers, directors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:
- Your use of HōMI
- Your violation of these Terms of Service
- Your violation of any rights of another party
- Any content you submit to the platform
Dispute Resolution
Informal Resolution
If you have a dispute with HōMI, please contact us first at support@hömi.com to attempt to resolve it informally.
Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if they qualify.
Class Action Waiver
You agree to resolve disputes with HōMI on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Wilmington, Delaware.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of HōMI after changes become effective constitutes your acceptance of the new terms.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.
Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and HōMI regarding your use of our services and supersede any prior agreements.
